DermaTherapy® Minimum Advertised Price (MAP) Policy

Effective October 1st, 2019
This Minimum Advertised Price (MAP) Policy supersedes all previous DermaTherapy® MAP Policies and Guidelines

Precision Fabrics (PFG) has unilaterally adopted this Minimum Advertised Price (MAP) Policy, which is applicable to all PFG authorized dealers (whether Internet, bricks and mortar, or both) with respect to dealer’s advertising of all DermaTherapy® for resale, regardless of advertising media.

1) Each DermaTherapy® dealer remains free to establish its own resale prices. However, a dealer may not:
(a) Advertise or otherwise promote DermaTherapy® products at a price less than the Minimum Advertised Price (MAP) established by PFG from time to time; or
(b) Sell or effect sales of DermaTherapy® products to or through any other person or entity (including any Internet sales platform) that advertises or otherwise promotes the sale of DermaTherapy® products at a price less than the MAP, or is likely to do so based on the person or entity’s commercial practices;

2) The initial MAP for DermaTherapy® products is attached to this Policy. PFG may change the MAP at any time, from time to time, on written notice to authorized dealers.

3) This Policy does not apply to sales of DermaTherapy® products to any governmental entity.

4) If an authorized dealer violates this Policy:

(a) On the first occasion, PFG will send a warning letter to the dealer, after which the dealer will have three (3) business days to comply with MAP;
(b) In the event a dealer does not correct the first defalcation within the time set forth above, or in the event of a repeated offense, PFG may, at its option:

(i) Freeze the dealer’s account for a period of at least six (6) weeks; and/or
(ii) Refuse to accept new orders for DermaTherapy® products from the dealer; and/or
(iii) Cancel outstanding orders from the dealer, to the extent PFG is contractually permitted to do so; and/or
(iv) Terminate its relationship with the dealer.

This Policy may not be altered, amended or withdrawn except in writing by PFG. No PFG representative or employee has the authority to alter this Policy or MAP, or to grant any exemptions or exceptions from the Policy, in any respect whatsoever.

Questions regarding this Policy must be directed to info@DermaTherapy.com. PFG neither invites nor entertains comments or complaints regarding dealer pricing, and will not discuss any third party dealer’s pricing or business with a dealer.
